Some noteworthy changes are presented below:<\/p>\n<p><strong><u>EU temporary relief from RTS 27 reporting<\/u><\/strong><\/p>\n<p>Last month, the European Parliament and the EU Council published <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=uriserv%3AOJ.L_.2021.068.01.0014.01.ENG&amp;toc=OJ%3AL%3A2021%3A068%3ATOC\" target=\"_blank\" rel=\"noopener noreferrer\">Directive (EU) 2021\/338<\/a>, amending MiFID II to help recovery from the COVID-19 pandemic. The Directive is coined by industry circles as the MiFID II \u2018Quick-Fix\u2019 Directive.<\/p>\n<p>The MiFID II \u2018Quick-Fix\u2019 Directive amends MiFID II, <em>inter alia<\/em>, by adding the following subparagraph in Article 27(3) \u2018<em>The periodic reporting requirement to the public laid down in this paragraph shall not apply until 28\u00a0February 2023. The Commission shall comprehensively review the adequacy of the reporting requirements laid down in this paragraph and submit a report to the European Parliament and the Council by 28\u00a0February 2022.<\/em>\u2019<\/p>\n<p>Member States are expected to adopt and publish by 28\u00a0November 2021 the laws, regulations and administrative provisions necessary to comply with the MiFID II \u2018Quick-Fix\u2019 Directive.<\/p>\n<p>The measures introduced by MiFID II \u2018Quick-Fix\u2019 Directive shall apply from 28\u00a0February 2022.<\/p>\n<p>There is a good chance that Member States will proceed to temporary relieve firms from RTS 27 reporting before formal transposition of the MiFID II \u2018Quick-Fix\u2019 Directive into local laws considering also last year\u2019s relevant regulatory forbearance that ESMA <a href=\"https:\/\/www.esma.europa.eu\/press-news\/esma-news\/esma-provides-clarifications-best-execution-reports-under-mifid-ii\" target=\"_blank\" rel=\"noopener noreferrer\">published<\/a>, but this still remains to be seen.<\/p>\n<p><strong><u>FCA supervisory flexibility on RTS 27 reporting<\/u><\/strong><\/p>\n<p>Last week, the FCA <a href=\"https:\/\/www.fca.org.uk\/news\/statements\/supervisory-flexibility-rts-27-reports-ten-per-cent-depreciation-notifications?mc_cid=9548e4a2f0&amp;mc_eid=1d231ed1d4\" target=\"_blank\" rel=\"noopener noreferrer\">published<\/a> a statement specifying that they are putting in place temporary measures with respect to RTS 27 reports while they consult on changes to these requirements later this Spring. Specifically, the FCA will not be taking action\u00a0against firms who do not produce RTS 27 reports <strong>for the rest of 2021<\/strong>.<\/p>\n<p><strong><u>FCA updates its UK EMIR\u00a0validation rules<\/u><\/strong><\/p>\n<p>On another development, last week, the FCA has <a href=\"https:\/\/www.fca.org.uk\/markets\/uk-emir\/reporting-obligation\" target=\"_blank\" rel=\"noopener noreferrer\">updated its validation rules<\/a> for UK EMIR. The update concerns field <u>1.30 Variation Margin Received<\/u> where the requirement to leave blank the said field if the Collateralisation field is populated with \u2018U\u2019 (Uncollateralised) has now been removed.
